Court In Session

‘This Court is in session, to hear opening statements in the case being brought before it, of the president just past of the United States having been ineligible for said office, and in consequence, to have everything that he was involved in over the eight years of his term in office needing to be canceled out, with said person to be arrested and brought to trial on numerous charges.  - ‘

‘May it please the Court.’

‘Yes, Counselor for the Defense; what is it?’

‘In the interests of time, Your Honor, this is, pure and simply, a frivolous lawsuit - and in actuality, even more than that.  It is a scurrilous attack on a fine man, and a blatant case of racism to boot, and should be thrown out of this court immediately, as tainting this court with its most foul excrescences.

‘Barack Hussein Obama was born in a state of these United States of American citizen parentage.  That makes him a natural born citizen.   Furthermore, he was overwhelmingly elected by the decent citizens of these United States as their president.  End of story.  

‘Now I’m sure that this Court has more important matters to attend to than to entertain any further this frivolous notion.  I move that it be thrown out, as the hogwash - and the racist hogwash at that - that it is.’

‘Do you rest your case before this Court at this time with that statement, Counselor?’

‘I do, Your Honor.  Enough is enough!  This business - ‘

‘Thank you, Counselor.  You have made your point.

‘Counselor for the Prosecution?’

‘Yes, Your Honor?’

‘You may proceed with your opening statement.’   

‘Thank you, Your Honor…  

‘And first, to ask of the Defense counselor, out of concern for his good health:

’Sir: Are your bowels not working properly?  Just wondering.  With all that shit coming out of your mouth, and all.’

‘Order!  Order!  There will be order in this courtroom!’

‘I apologize to this Court, Your Honor.  I will not apologize to this asshole; this vile specimen - ‘

‘Counselor!’

‘ - of a msn, who would bend the law to suit his ends, and employ vituperation as though it were a legitimate defense.  But I will continue, to the case at hand, in deference to this court, Your Honor.’

‘Please do, Counselor.  And I will admonish both counselors, that there will be no more outbursts of this nature in this Court.  Is that clear to you both?’

(Together; seemingly penitently:) ‘Yes, Your Honor.’

‘Alright.  Now that that is clear, you may proceed, Counselor for the Prosecution.  And make it short.  My patience is at a limit.’

‘Short and sweet, Your Honor.  For it is really very simple.  An open and shut case.          

‘The historical record is very clear on this matter.  The definition of a ‘natural born’ citizen - as opposed to any other kind of citizen, naturalized or simply a born citizen - that was commonly known in the former colonies at the time that the constitutional Framers inserted it in their contract as an eligibility requirement for that particular office - and that particular office only; signifying its special nature to them, in their minds; particularly as regards the occupant of said office also becoming, then, the Commander in Chief of the nation’s military forces - a consideration that I will submit evidence in support of - said definition was of a person, quote, “born in the country, of citizens who are parents,” unquote.  And that eligibility requirement for that particular office still stands, absent a constitutional amendment to the contrary.

‘Your Honor, - ‘

‘Quiet, Counselor for the Defense.  The Counselor for the Prosecution is simply presenting a summary of his case.  You may proceed, Counselor for the Prosecution.’

‘Thank you, Your Honor. 

‘The definition is from the definitive tome of the day on such matters, Emmerich de Vattel’s ‘The Law of Nations’.  Book One, Chapter Nineteen, Section 212, as per evidence that I will be submitting to this honorable Court.  

‘And as to the matter of the importance of that treatise to this matter, and my case, I will be submitting evidence to this Court regarding the esteem in which it was held by the constitutional Framers, via a very important personage to the history of this nation; who was a delegate himself to those self-same proceedings, and was their elder and well respected mentor; and whom they could have checked with at any time, if they were not familiar with any detail of the proceedings of the Constitutional Convention.  I refer to Benjamin Franklin.    

‘I have a copy of a letter here, which I will be submitting into evidence, that B. Franklin sent to the person who sent him three copies of said treatise, indicating his pleasure with them, both as a gift and as material; the latter factor supplemented by the fact that he gave one of those copies to the Continental Congress, for its edification on such nation-building matters.  In addition, I have - ‘

‘Objection, Your Honor!’

‘What is it, Counselor.  And this had better be good.’

‘You are giving the counsel for the Prosecution undue time to present his case, Your Honor.  This is merely a preliminary - ‘

‘I know what this is, Counselor.  But I take your point. 

‘Counselor for the Prosecution, do you wish to wrap up your preliminary comments at this time?’

‘Alright, Your Honor.  I trust that I have made my point: that there is a very serious matter here, that this Court is being asked to be allowed to entertain: It has to do with the very rule of law of this nation; and if we are going to honor it, and run our lives by it.  Or not.  And I will submit other materials that I have here, for this Court’s edification on this extremely important matter.’

‘Thank you, Counselor.  And thank you both for your preliminary statements.  Sort of…

‘This Court will take both of these preliminary statements into advisement, and render its decision, as regards proceeding with this case or not, in due course.  For now:

‘This court is adjourned.’
