On The Mixup Before Dawn


(Followup to my blog of late last night to my relative Re: Trump’s parentage:)

To clarify on the matter of Trump’s parents:  I got confused between his father and his grandfather.  His father was born in this country (in 1905), of his father being permanently resident n this country legally.  Now: Would that make his father automatically a U.S. citizen, and thus passing it on to Donald?

As long as the grandfather was legally domiciled in this country, I would think that he would technically be considered as having been “subject to the jurisdiction” of it; and thus his children born here could reasonably be considered as having U.S. citizenship.  Whereas a child born here of illegal aliens would be, as true of/following suit with its parents, “subject to the jurisdiction” of them, to say, of their home country (and especially of the father, whose surname the child takes).*   

But as I say, I think it will all be moot anyway.  But just to clarify.


* And thus this business of ‘anchor babies’ is fallacious.  It is based on a false reading of the 14th Amendment; which says:
   “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States, and of the State wherein they reside…”   (My emphasis)  Illegal aliens are ‘subject to the jurisdiction’ of their home countries.  Thus, al this business (and it is; big business) of, for pertinent example, pregnant Chinese women coming here on holiday and having babies in this country in order to confer on them U.S. citizenship is fallacious; the same with anyone here who is not  a U.S. citizen, for example, a family on diplomatic mission. 


[N.B. But does a permanent resident here, who however has not taken out naturalization, automatically confer U.S. citizenship on their children???….
